American International School dragged to Court over N4.5m fraud

The Registered Trustees of American International School, Abuja has allegedly defrauded a parent named Mrs. Florence Omadachi of the sum of four million five hundred thousand naira.
The American International School on the 21st April, 2016 through the finance department sent an electronic mail (E-mail) to the said parents that the new policy of the school is an advance payment to guarantee the placement of pupils for the academic session of 2016/2017.
Furthermore, the school authority stated that late payment will not guarantee any space in the school in addition to a 10% penalty for defaulters.
The said parents sourced and rallied for funds and on the 25th May, 2016 paid the sum of 4,5000,000 Four Million Five Hundred Naira through a direct transfer payment in the school’s bank account no. 4266644272 Guaranty Trust Bank to the school authority as the first Semester tuition fee for 2006/2017 academic session .
On confirmation of the transfer and payment, the School authority issued the school’s receipt in the child’s name as advance payment.
The parent upon reviewing the academic development and performance of their child by 29th July, 2016 decided to withdraw their child from the school.
The said parent requested for the refund of payment in accordance with the 6th item at page 9 of the Elementary School Parent/Student Handbook with states that with respect to Refund of Tuition Fees upon withdrawal or dismissal Tuition is refundable only for full unused semesters.
The said parents claimed the newly introduced policy takes effect from 15thAugust, 2016.
The demand for refund was communicated to the head of the School; Mr. Wallace Ting through the electronic mail at the time the School had not rendered any service to the said child in respect of the disputed 2016/2017 academic session.
The defrauded parent suing on behalf of their child Echeipu Odoh Oklobia in the fresh suit with number: FCT/HC/CV/2541/12016 at the High Court of the Federal Capital Territory in the Abuja Judicial Division, Abuja.
The Plaintiff Echeipu Odoh Okhlobia a minor suing through his next friend Mrs. Florence Oklobia is praying for an order of the High Court, Abuja for the refund of the sum of N4, 500,000 Four Million Five Hundred Thousand Naira being the advance payment made for 2016/2017 academic session on behalf of the Plaintiff.
The Plaintiff also claims for a 10% interest on the judgment sum effective from the date of judgment till the judgment sum is fully realized.
Likewise the Plaintiff demanded the cost of the sum of N5, 000,000 Five Million Naira.
In the bid to recover the 4,500,000 Four Million Five Hundred Thousand Naira paid to the Defendant, the Registered Trustees Of American International School, Abuja the Plaintiff had incurred an extra expense of N2, 500,000 Two Million Five Hundred Thousand Naira being payment made to the Plaintiff’s Counsel Messrs Akinboro SAN & Co. to undertake the refund from the Defendant.
