Jime Vs Ortom: PDP closes case,Says petitioners have not established any case

The Peoples Democratic Party, PDP, today opened and closed its case in the suit instituted by Emmanuel Jime and the All Progressives, APC, challenging the reelection of its candidate, Governor Samuel Ortom.

When the case resumed today, counsel to the PDP, Chris Uche , SAN, told the tribunal that since the petioners have not been able to prove their case, the PDP was not calling any witness.

“Cognisance of the right principle of the law that a petitioner in a suit can only succeed on the strength of of his case, we have carefully studied and analyzed all the evidence, testimonies of all the witnesses called by the petitioners, we have carefully considered the documents and the evidence elicited from the petitioners witnesses which we can consider favorable to us, we are of the humble view that we may not need to labour your Lordships by calling witnesses.

“The petitioners have not been able to prove their case, I rely on the provisions of paragraph 46(5) of the first schedule of the Electoral Act to formally move an oral application to close the case of the third respondents,” he submitted.

The Tribunal Chairman, Justice Henry Olusiyi granted the prayers of the PDP counsel, and gave the parties 20 days within which they will file their written addresses and adjourned the matter to September 11, 2019 for adoption of written addresses.

Speaking to newsmen on why the PDP closed its case without calling a witness, the State Legal Adviser of the Party, Barr. Clement Mue said all the 59 witnesses called by Jime and the APC were hear say witnesses and were also unable to establish what they alleged in the petition.

He added that the APC brought a truck load of documentary and dumped on the tribunal without making any reference to them

He concluded that the party after reviewing the evidence of the petitioners didn’t see any need to call witnesses as the petitioners didn’t establish any case.
